artt.pro (the "Platform") is operated by the Latvia-registered company identified in our Legal Notice ("we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of the Platform.
By creating an account or using the Platform, you ("Artist", "you", "your") agree to these Terms. If you do not agree, you must not use the Platform.
artt.pro lets you:
We provide the physical production and shipping of framed products. Product previews and prices in the configurator are generated by our framing and print-production provider and are indicative until an order is placed.
To use the Platform, you must:
You are responsible for activity under your account and must notify us of any unauthorised use.
When you place an order for production through the Platform:
Our handling of damaged items and reprints is described in our operational policies and provided on request.
You agree not to:
The Platform, including its software, designs, text, graphics, and logos, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Platform in accordance with these Terms.
You retain ownership of the artwork and content you upload ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and process Your Content solely to provide the Platform and produce and ship your orders (including via our fulfilment provider).
You represent and warrant that Your Content does not infringe any third-party rights and that you hold all rights and permissions needed to upload and sell it.
Our processing of personal data is described in our Privacy Policy. For end-customer data used to fulfil orders, you are the data controller and we act as your processor; you are responsible for having a lawful basis and for informing your customers that their order data is shared with artt.pro for production and delivery.
We provide the Platform with reasonable care and skill. To the extent permitted by law, and without limiting any mandatory rights you have under EU or Latvian law, the Platform is provided "as is" and we do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under any mandatory statutory or consumer-protection right.
Subject to the above, and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, data, or business, and our total liability for claims arising from or related to the Platform is limited to the amounts you paid us in the 12 months before the claim.
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, liabilities, damages, losses, and reasonable costs arising out of your use of the Platform, your breach of these Terms, your violation of any law or third-party right, or Your Content (including any infringement of intellectual property rights).
These Terms apply from when you first access the Platform until terminated by either party.
You may stop using the Platform and close your account at any time.
We may suspend or terminate your access if:
On termination, your right to use the Platform ends. Outstanding amounts remain payable, and we may retain data as required by law or as described in our Privacy Policy.
We may modify, suspend, or discontinue the Platform (or parts of it) at any time.
We may update these Terms from time to time. The updated Terms will be posted here with a revised date, and material changes will be communicated to active artists. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of Latvia, and the courts of Latvia have jurisdiction over disputes, without prejudice to any mandatory consumer-protection rights and protections available to you under the law of your EU country of residence.
Before starting legal proceedings, please contact us so we can try to resolve the matter. If you are a consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
