1. Introduction

artt.pro (the "Platform") is operated by the Latvia-registered company identified in our Legal Notice ("we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of the Platform.

By creating an account or using the Platform, you ("Artist", "you", "your") agree to these Terms. If you do not agree, you must not use the Platform.

2. The Service

artt.pro lets you:

  • upload your artwork and design premium framed products and their variants in our configurator;
  • sell those products through your own sales channels (such as a connected Shopify store);
  • place production orders with us, which we produce and ship to your customers on your behalf;
  • manage order production, tracking, branding, and fulfilment preferences.

We provide the physical production and shipping of framed products. Product previews and prices in the configurator are generated by our framing and print-production provider and are indicative until an order is placed.

3. Account and Eligibility

To use the Platform, you must:

  • provide accurate, current, and complete registration information;
  • keep your account credentials secure;
  • be at least 18 years old and able to enter into a binding contract;
  • comply with all applicable laws.

You are responsible for activity under your account and must notify us of any unauthorised use.

4. Subscriptions, Pricing, and Payment

  • artt.pro offers a free tier and a paid subscription tier that unlocks premium materials, custom sizes, and branding. Subscription fees are shown before you subscribe.
  • For each production order you place, you pay the production and shipping price shown at the time of placement. We do not add a per-order markup — our revenue is the subscription.
  • All prices and charges are in euro (EUR).
  • Charges are collected through our payment provider (Stripe) using your saved payment method. You authorise us to charge that method for subscription fees and production orders you place.
  • We are the seller and VAT issuer of record. VAT is applied according to your location and status; where you are a VAT-registered business in another EU member state and provide a valid VAT number, the reverse-charge mechanism may apply.
  • Prices for the framed products are set by our framing and print-production provider and may change; the price that applies to an order is the one shown when you place it.
  • We may change subscription pricing on reasonable prior notice to active artists.
  • Late or failed payment may result in suspension of production and fulfilment.

5. Orders, Production, and Fulfilment

When you place an order for production through the Platform:

  • you authorise us to produce and ship it to your customer on your behalf;
  • the price and specification are captured (snapshotted) at placement and used for that order;
  • you are responsible for ensuring product details, images, and specifications are correct and do not infringe any third-party rights;
  • production and shipping times are estimates, not guarantees;
  • once production has commenced, cancellation may not be possible;
  • we may reject or cancel orders that breach these Terms or contain illegal or infringing content.

Our handling of damaged items and reprints is described in our operational policies and provided on request.

6. Acceptable Use

You agree not to:

  • use the Platform for any unlawful or fraudulent purpose;
  • attempt to gain unauthorised access to the Platform or related systems;
  • reverse engineer, decompile, or disassemble any part of the Platform, except as permitted by law;
  • transmit viruses, malware, or other harmful code;
  • remove or alter any proprietary notices;
  • resell, sublicense, or redistribute the Platform without our prior written consent;
  • upload or submit content that infringes third-party intellectual property or other rights.

7. Intellectual Property

a. Our rights

The Platform, including its software, designs, text, graphics, and logos, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Platform in accordance with these Terms.

b. Your content

You retain ownership of the artwork and content you upload ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and process Your Content solely to provide the Platform and produce and ship your orders (including via our fulfilment provider).

You represent and warrant that Your Content does not infringe any third-party rights and that you hold all rights and permissions needed to upload and sell it.

8. Data Protection

Our processing of personal data is described in our Privacy Policy. For end-customer data used to fulfil orders, you are the data controller and we act as your processor; you are responsible for having a lawful basis and for informing your customers that their order data is shared with artt.pro for production and delivery.

9. Warranties and Disclaimers

We provide the Platform with reasonable care and skill. To the extent permitted by law, and without limiting any mandatory rights you have under EU or Latvian law, the Platform is provided "as is" and we do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose.

10. Limitation of Liability

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under any mandatory statutory or consumer-protection right.

Subject to the above, and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, data, or business, and our total liability for claims arising from or related to the Platform is limited to the amounts you paid us in the 12 months before the claim.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, liabilities, damages, losses, and reasonable costs arising out of your use of the Platform, your breach of these Terms, your violation of any law or third-party right, or Your Content (including any infringement of intellectual property rights).

12. Term and Termination

These Terms apply from when you first access the Platform until terminated by either party.

You may stop using the Platform and close your account at any time.

We may suspend or terminate your access if:

  • you breach these Terms;
  • payment is overdue;
  • we are required to do so by law; or
  • we cease to offer the Platform.

On termination, your right to use the Platform ends. Outstanding amounts remain payable, and we may retain data as required by law or as described in our Privacy Policy.

13. Changes to the Platform and Terms

We may modify, suspend, or discontinue the Platform (or parts of it) at any time.

We may update these Terms from time to time. The updated Terms will be posted here with a revised date, and material changes will be communicated to active artists. Continued use after changes take effect constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of Latvia, and the courts of Latvia have jurisdiction over disputes, without prejudice to any mandatory consumer-protection rights and protections available to you under the law of your EU country of residence.

Before starting legal proceedings, please contact us so we can try to resolve the matter. If you are a consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. General

  • Entire agreement: these Terms are the entire agreement between you and us regarding the Platform and supersede prior agreements.
  • Severability: if a provision is invalid or unenforceable, the rest remains in effect.
  • Waiver: our failure to enforce a right is not a waiver of it.
  • Assignment: you may not assign these Terms without our consent; we may assign them where permitted by law.
  • Force majeure: we are not liable for failure or delay caused by events beyond our reasonable control.
